The simple act of bringing parties together in a safe, private and structured forum to listen to one another, can greatly influence how soon and how well a case is settled. And yet, our society’s traditional approach to conflict resolution – litigation – is founded upon a model more akin to war than peace talks. This model is particularly tragic in the area of divorce, pitting spouses (often parents) against each other and attempting to apply rigid, one-size fits-all laws to intimate relationships involving the deepest of emotions and with lifelong consequences.
My training and experience in mediation and collaborative law has led me to believe that it is irrational to expect that an adversarial process involving generic standards and limited options for relief has much of a chance in bringing together parties who are experiencing profoundly personal and intense emotional trauma.
While I offer a range of services, they are all founded upon a core belief that clients have the right to choose between a traditional court-imposed process and a client-centered, private and thoughtful one. Experience has shown me that most divorcing spouses are capable of working together honorably and gracefully, even when there has been a history of conflict or betrayal.
